You have 90 days, and it is only within the same generation of cards.

So 8800 to 8900 is fine, but 8800 to 9800 isn't.

It doesn't have to be within the same generation or even the next generation. The practical implications of the 90 day requirement limit you to stepping up to a refresh of the current generation or the next generation and no further (since you never see 2 generation jumps within 3 months) but there's nothing in the Step-Up program itself that limits you to any particular generation.

I know a few people that bought a 7900gtx or 7950GX2 that were buying just to step up to an 8800 and it didn't happen...

Hmmm... they seemed to have updated the Terms and Conditions after the G80 launch, but "forgot" to update the date they put up there.  No I don't have anyway to prove that.  But I know I read in the Terms and Conditions at the time of the G80 launch, that you cannot stepup from an older generation.

ATI does a trade in program of any ATI made card for $50usd. Any generation doesnt matter and I believe company doesnt matter either. That latter I am not sure on, but that is what it sounded like from the guy I was on the phone with. but eVGA is the only nvidia company.

yep my friend was denied the other week actually, which is the reason why he went early on a 7950gx2. Now he cant get a 8800gtx.
